Placement Terms

These Placement Terms govern the use of HireSEATalent’s recruitment and talent placement services. By engaging HireSEATalent to source, screen, introduce, or place a candidate, you agree to these terms.

01

About Our Placement Service

HireSEATalent provides recruitment and talent placement services connecting companies with pre-screened remote professionals from Southeast Asia.

Our service includes candidate sourcing, initial screening, skills and communication assessment, candidate shortlisting, and support through the hiring process.

HireSEATalent acts as a recruitment and placement partner. We do not operate as a freelancer marketplace or employ candidates on behalf of the hiring company.

02

Client Hiring Requirements

Before sourcing candidates, the client provides information about the role, including where relevant:

  • Job title and responsibilities
  • Required skills and experience
  • Working hours and timezone requirements
  • Compensation expectations
  • Employment or engagement requirements
  • Company culture and team structure
  • Other qualifications or requirements relevant to the position

The client is responsible for providing accurate and complete information so that HireSEATalent can identify suitable candidates.

03

Candidate Sourcing and Screening

HireSEATalent may source candidates from its talent network and other recruitment channels.

Candidates may be screened based on factors including:

  • Relevant professional experience
  • Technical or role-specific skills
  • Communication and English proficiency
  • Work history and background
  • Availability
  • Role and company fit

Screening is intended to support the recruitment process and does not constitute a guarantee of a candidate’s future performance, suitability, or conduct.

The final decision to interview, select, and hire a candidate remains with the client.

04

Candidate Introduction

A candidate is considered introduced to the client when HireSEATalent provides the candidate’s profile, resume, contact information, interview details, or other identifying information for consideration for a role.

If a client hires an introduced candidate, the applicable placement fee will become payable in accordance with the agreed commercial terms.

05

Placement Fee

HireSEATalent charges a placement fee for successful candidate placements.

The applicable fee, payment terms, and any other commercial conditions will be communicated to the client before or during the recruitment process.

Unless otherwise agreed in writing, the placement fee applies when the client hires a candidate introduced by HireSEATalent.

The placement fee is separate from the candidate’s salary, compensation, benefits, taxes, payroll costs, and other employment-related expenses.

06

No Upfront Fee to Explore Candidates

Clients may submit their hiring requirements and explore available candidates without an upfront placement payment.

A placement fee becomes applicable when a successful hire is made, subject to the agreed commercial terms.

07

Direct Hiring Relationship

Once a candidate is hired, the employment or engagement relationship is directly between the client and the candidate unless otherwise agreed in writing.

The client is responsible for determining and managing:

  • Employment or contractor agreements
  • Compensation and benefits
  • Payroll
  • Working arrangements
  • Tax obligations
  • Local employment requirements
  • Ongoing performance management
  • Other employer or contracting responsibilities

HireSEATalent’s role is to facilitate the recruitment and placement process.

08

Replacement Guarantee

HireSEATalent provides a replacement guarantee for eligible placements, subject to the applicable placement terms.

If an eligible hire does not continue within the agreed guarantee period, HireSEATalent may provide a replacement candidate at no additional placement fee.

The replacement guarantee applies only where the conditions specified in the applicable client agreement are satisfied.

The replacement process is limited to sourcing and presenting replacement candidates and does not constitute a refund unless expressly agreed in writing.

09

Replacement Conditions

A replacement may be subject to conditions including:

  • The original placement fee has been paid in full.
  • The client has notified HireSEATalent within the applicable guarantee period.
  • The reason for replacement falls within the scope of the guarantee.
  • The client has complied with the agreed hiring and engagement terms.
  • The original role remains substantially similar to the role for which the candidate was placed.

The replacement guarantee does not automatically apply to every termination or change in employment circumstances.

Specific exclusions and conditions may be set out in the client’s placement agreement.

10

Client Responsibilities

The client is responsible for:

  • Reviewing candidate profiles carefully
  • Conducting interviews and any additional assessments they consider appropriate
  • Making the final hiring decision
  • Providing accurate information about the role
  • Communicating employment or engagement terms clearly
  • Complying with applicable employment, tax, privacy, and other laws
  • Managing the candidate after placement

HireSEATalent does not guarantee that a candidate will meet every expectation of the client or remain in the role for a particular period, except as expressly covered by the applicable replacement guarantee.

11

Candidate Responsibilities

Candidates are responsible for providing accurate information about their qualifications, experience, availability, and other relevant information.

HireSEATalent may rely on information provided by candidates during the screening and recruitment process.

Any material misrepresentation may result in the candidate being removed from consideration or other appropriate action.

12

Confidentiality

Both the client and HireSEATalent should treat confidential business, candidate, and recruitment information received during the placement process as confidential and should not disclose such information except where necessary to perform the recruitment process or where required by law.

Clients must not use candidate information for purposes unrelated to the recruitment opportunity for which the candidate was introduced without appropriate authorization.

13

Candidate Data

Candidate personal information is handled in accordance with HireSEATalent’s Candidate Data Privacy Policy.

By participating in the recruitment process, clients agree to handle candidate information responsibly and in accordance with applicable privacy and data protection laws.

14

Non-Circumvention

Where a candidate has been introduced by HireSEATalent, the client must not intentionally bypass HireSEATalent’s placement process to avoid applicable placement fees.

If the client subsequently hires an introduced candidate for the same or a substantially similar role within the applicable period specified in the client agreement, the placement fee may remain payable.

Any specific non-circumvention period and conditions will be set out in the applicable commercial agreement.

15

No Guarantee of Hiring Outcome

Where a candidate has been introduced by HireSEATalent, the client must not intentionally bypass HireSEATalent’s placement process to avoid applicable placement fees.

If the client subsequently hires an introduced candidate for the same or a substantially similar role within the applicable period specified in the client agreement, the placement fee may remain payable.

Any specific non-circumvention period and conditions will be set out in the applicable commercial agreement.

16

Changes to Placement Terms

HireSEATalent may update these Placement Terms from time to time.

The version applicable to a placement will generally be the version agreed with the client at the time the relevant recruitment engagement or placement takes place, unless otherwise agreed in writing.

17

Governing Terms

Any placement engagement may also be governed by a separate agreement, proposal, order form, or commercial terms agreed between HireSEATalent and the client.

Where there is a conflict between these general Placement Terms and a specific written agreement, the specific written agreement will take precedence.
